Terms of Service
SBK is not a substitute for 911 or any official emergency, police, medical, or rescue service. It is a supplemental, community-based safety tool that depends on your device, battery, signal, third-party networks, and the people in your Circle. We do not guarantee that an alert will be created, delivered, seen, or acted upon. In an emergency, contact 911 or your local emergency number directly.
By creating an account, installing, or using SBK, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App. If you use SBK on behalf of a minor as a parent or legal guardian, you accept these Terms on the minor’s behalf and on your own.
Everyone is bound by the same Terms, without exception. Every user of SBK — including any adult you add to your Circle who may receive or view a minor’s location — must accept these Terms and the Privacy Policy before participating. No person may receive or view a minor’s location through SBK without first accepting these Terms.
SBK Version 1 is available only in the United States and only to users aged 13 and older. For purposes of these Terms, a “minor” means a user aged 13 to 17.
Age verification is a mandatory legal requirement, not an option. Your date of birth is collected at sign-up and must be provided before any consent interaction. SBK does not knowingly permit registration by children under 13; accounts reporting an age under 13 are blocked and are not created.
A minor (13–17) may use SBK only with the verifiable consent and supervision of a parent or legal guardian, who establishes a guardian link in the App and accepts these Terms on the minor’s behalf and on their own. A parent or guardian who links a minor represents that they have legal authority to consent to the collection and sharing described in the Privacy Policy, and may review or delete the minor’s data at any time.
Collection of personal information from children under 13 with verifiable parental consent under the Children’s Online Privacy Protection Act (COPPA) is not offered in Version 1 and is reserved for a future release.
You are responsible for the accuracy of your information, for keeping your credentials secure, and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
SBK lets you build a “Circle” of trusted contacts you choose. You are solely responsible for whom you add, for ensuring they consent to participate, and for the accuracy of their contact details. Circle members can receive your alerts, view your live location during an active alert, and participate in escalation decisions. Every Circle member — adult or minor — must accept these Terms and the Privacy Policy before they can receive your location. Do not add anyone without their knowledge and agreement. We are not responsible for the conduct of Circle members.
SBK can activate via user-defined voice phrases, manual controls, and other methods. When activated, SBK enters “Telematics Mode,” generating location and movement data (a “breadcrumb”) shared with your Circle until you resolve or cancel the alert. SBK does not track your location before activation except as expressly described in the Privacy Policy. Voice detection, background operation, and notification delivery depend on your device settings and operating-system limits and may not function in all circumstances.
SBK may let your Circle vote to escalate an alert, which can trigger a notification to a contact you designate. SBK does not contact 911 or dispatch emergency responders on your behalf and cannot guarantee any third party will respond. Escalation outcomes depend on member participation and connectivity.
We collect only what SBK’s native safety purpose requires, and we use it only for that purpose: to help your Circle, your verified emergency contacts, and — where lawfully requested — authorities locate and assist you or a linked minor. We do not use your information for any unrelated purpose.
We do not sell your personal information, and we do not sell or share minors’ personal information. It is the intention of developer Noratec LLC, and its assigns, agents, and successors-in-interest, to implement permanent blocking of the collection, sale, and sharing of minors’ personal data, and usage of our services constitutes an irrevocable acceptance of that protection without opposition or challenge at all times.
Location and movement data generated during an alert are retained for no longer than 30 days and are then purged, except where a longer period is required to comply with law or a lawful request.
Emergency contacts must be verified before they can receive a minor’s information, and their details are retained in the record for the specific minor they support. During an active alert, and where lawfully requested by police or emergency authorities to assist in locating a minor or user, we may share the information available in our systems for that purpose. We share data only to further SBK’s stated safety purpose.
SBK offers paid subscription tiers. Purchases are processed by the Apple App Store or Google Play under their terms; we do not receive your payment-card details. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period and are managed through your app-store account. Refunds are governed by the applicable app store’s policies. Prices, tiers, and features may change prospectively with notice. If your subscription lapses, after a 14-day grace period the members you added to your Circle are paused (not deleted) and are automatically restored, up to your plan’s capacity, when you resubscribe; the reciprocal “protectors” who invited you remain in your Circle free of charge.
You agree not to misuse SBK to harass, stalk, surveil, or endanger anyone; to trigger false alerts; to use SBK for any unlawful purpose; to access data you are not authorized to access; to reverse engineer, disrupt, or overload the Service; or to monitor a person without their lawful consent. Misuse may result in termination and may be reported to authorities.
SBK relies on third-party providers including, without limitation, our backend/database, messaging, app-platform, notification, and mapping providers. Your use may be subject to their terms, and we are not responsible for their acts, omissions, or availability.
SBK, its branding, and content are owned by Noratec and protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the App for its intended personal-safety purpose. You retain rights to content you submit but grant us a license to process it to operate the Service.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ALERTS OR LOCATION DATA WILL BE DELIVERED OR ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NORATEC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE RELATED TO USE OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
You agree to indemnify and hold Noratec harmless from claims arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
Noratec is further held harmless from the oversight, errors, or omissions of secondary distributors of the App, including the Apple App Store and Google Play. Your use of those platforms is governed by their own terms, and Noratec is not responsible for their acts or omissions.
You may stop using SBK and delete your account at any time. We may suspend or terminate access for violations or to protect the Service or its users. Sections that by their nature should survive termination — including data-protection, disclaimers, limitation of liability, indemnification, and dispute-resolution provisions — will survive.
We may update these Terms; material changes will be notified in-app or by email, and continued use after the effective date constitutes acceptance.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules.
You irrevocably consent to the resolution of all disputes, conflicts, and claims through binding arbitration pursuant to the Federal Arbitration Act (FAA), 9 U.S.C. § 1 et seq. To the extent permitted by law, you and Noratec each waive any right to bring or participate in a class action. Noratec’s total liability, if any, will be subject to final arbitral determination.
